Canadian HR: Implement an Enforceable Employment Contract


In Canada, employees get paid severance not to work. This includes employees fired for poor performance. A properly drafted employment contract can be the magic bullet. Employers can contract out of out expensive severance payments and uncertainty surrounding terminations. Sometimes, however, this is more difficult than it seems. Only if the contract meets a number of legal tests will it be upheld.
