Managing OSHA and MSHA Inspections and Accident Investigations

Join us for 90-minute audio conference as we address sound management of OSHA and MSHA inspections and accident investigations, from both safety and legal perspectives. This course will instruct on basic concepts of risk and legal management, avoidance of self-incrimination, agency document and recordkeeping requirements, and methods of minimizing citations and civil/criminal legal exposure under the OSH Act and the new MINER Act.

Learning Objectives:

  • Minimize legal liability through self-assessment and program development in advance of inspections.
  • Establish inspection and document-related procedures that will foster compliance with record keeping standards while reducing legal exposure.
  • Develop accident investigation and crisis management protocols.
  • Learn how to productively utilize inspection experiences to refine safety programs and promote compliance.
  • Understand concepts such as the General Duty Clause (OSHA), strict liability (MSHA), and warrant and subpoena issues associated with enforcement activities.

Adele L. She is a Certified Mine Safety Professional, a Department of Labor-approved trainer, and a trained mediator who handles employment and worker's compensation cases. In the early 1990s, she served on a Department of Labor task group to promote Job Safety Analysis in the mining industry.

She also is a professional member of the American Society of Safety Engineers, the International Society of Mine Safety Professionals, and the Energy and Mineral Law Foundation. She is chairman of the National Safety Council's Business & Industry division committee on regulatory and legal affairs. Ms. Abrams is admitted to the Maryland and DC bars, the U.S. District Courts of Maryland and DC, the U.S. Court of Appeals, DC Circuit, and the Supreme Court of the United States .
